Montenegrin Supreme Court Delays Do Kwon’s Extradition to South Korea

The Montenegrin Supreme Court has delayed the extradition of Do Kwon to South Korea.

According to a recent report by Vijesti, the decision was made after the Supreme State Prosecutor’s Office (VDT) filed a request for the protection of legality, proposing to postpone the execution of the decisions by the High Court in Podgorica and the Court of Appeal.

Supreme State Prosecutor’s Office Requests Review

The report indicated that the request by the Prosecutor’s Office aimed to review whether the extradition conditions to South Korea were legally met.

“At today’s session of the council, a decision was made that determines the postponement of the execution of the decision of the High Court in Podgorica and the Court of Appeal of Montenegro,” the court statement reads.

The reaction of the VDT came a day after the Court of Appeal upheld the High Court in Podgorica’s decision to approve Do Kwon’s extradition. The latest ruling would prevent the Police Directorate and the Ministry of Justice from proceeding with the extradition immediately.

The Court also announced that the extradition of Do Kwon will be postponed until a decision is made on the Request for the Protection of Legality. This decision is expected to be made within the legal deadline.

Do Kwon’s Defense Attorney on Postponement Decision

“Revision of a final decision, which is in favor of the defendant, is not possible except with abuse of position,” said Do Kwon’s defense attorney Goran Radić.

“Since a final decision cannot be changed in a legal way, then there is no point in delaying its execution, but for the sake of future judicial practice, the Supreme Court can discuss this issue in the regular procedure in accordance with the usual work dynamics,” said Rodić.

As the Montenegrin Court ruled that Kwon will be extradited to South Korea, the appeal to extradite him to the U.S. was rejected. Kwon faced charges in both countries after the collapse of Terraform Labs.
