CLARITY Act Faces A 48-Hour Clock

The Senate leaves August 10 for a break that runs through September 11, per its published schedule. A cloture motion must ripen before senators can vote. Every hour Thune waits eats into the week.

The Digital Asset Market Clarity Act would divide crypto oversight between two agencies. The Commodity Futures Trading Commission (CFTC) would handle most tokens. The Securities and Exchange Commission (SEC) would keep the rest.

The House passed the bill 294-134 in July 2025. The Senate Banking Committee then advanced it 15-9 on May 14.

So the votes exist. Finding 60 of them is the problem.

Ethics language is the blocker. Democrats want tighter limits on federal officials promoting digital assets. Punchbowl News reported this week that they will withhold cloture until the White House moves.

“We are clearly here, trying to engage in a constructive manner. At this point, if they’re not engaging, it’s telling me that they don’t want this to happen,” Sen. Ruben Gallego, D-Ariz., told Punchbowl News.

Sen. Cynthia Lummis, R-Wyo., blames the other side. She says 11 months of talks have gone nowhere.

A Failed Vote is Not a Dead Bill

Crypto has been here before. The GENIUS Act, the stablecoin law, lost its first cloture vote 48-49 in May 2025. Democrats walked away over similar objections.

Five weeks later, the same bill passed the Senate 68-30. It was signed that July. A blocked cloture vote proved to be a bargaining step, not an ending.

The calendar is tighter this time. The Senate returns September 14, then leaves again on October 5 for the midterm campaign. That leaves about three working weeks.

What Bitcoin Loses If the Clock Runs Out

O’Leary, the Shark Tank investor, ties institutional money to a law, not an agency rulebook.

“Bitcoin’s going nowhere until the CLARITY Act becomes law,” he said that on Fox Business in June.

Two months on, the bill has not moved. Other forecasters pin a $200,000 Bitcoin target to passage.

The market is not pricing that. The Bitcoin price today sits near $64,126, up 0.5% on the day. Polymarket contracts on a 2026 signing trade at 17% across $5.03 million in volume, down from above 70% in February.

Galaxy analysts cut their passage odds in June, blaming the calendar rather than the policy.

Regulators Move Either Way

CFTC Chairman Michael Selig has rule proposals ready to go. He intends to use them with or without Congress, Law360 reported this week. He can act fast because he is the only sitting commissioner on a five-seat panel.

That path is reversible, though. A successor can undo agency rules without a vote. A statute outlasts the next election. Former CFTC Chairman Chris Giancarlo argues crypto innovation continues either way.

Thune can still file on Friday and drag a vote into the weekend.

If he does not, the GENIUS timeline says the bill is not dead. It just gets three weeks in September to prove it.
